Terms & Conditions

Draft · effective date: [TBA]

1. The agreement

These terms apply to the Aerial Editor website, browser editor, desktop software and associated account services supplied by [legal entity or individual TBA], trading as Aerial Editor, ABN [TBA], of [business address TBA] (“we”, “us”). Contact: info@aerialeditor.com.

You accept these terms when you agree to them to open an account or use paid services. If you use the service for an organisation, you must have authority to bind it. The service is intended for adult professional and business users; you must be at least 18. A dated copy will remain accessible from the website and application.

2. Accounts and access

Give accurate account details, keep them current and protect your login. Use authorised team access instead of sharing passwords. Tell us promptly if you suspect unauthorised use. We will investigate disputed activity; these terms do not automatically make you liable for every action carried out using compromised credentials.

Access to some tools depends on your account, build, provider connection or launch stage. A preview or demonstration does not mean a feature is available to every account.

3. Using the editor

We give you a limited, non-exclusive right to use the software for authorised editing while your access remains valid. You must not attack the service, bypass payment or access controls, infringe others’ rights, or use it unlawfully. Reasonable restrictions protect the service and do not remove rights permitted by law.

You retain rights in your original files and your own creative work. You grant us permission to process, store and transmit submitted material only as needed to provide requested services, support and security. We will not use your images in advertising without separate permission. AI outputs may not be unique and their legal protection depends on applicable law and provider terms.

4. Pricing and export payment

The amount, currency, applicable tax and chargeable deliverables will be shown before purchase. You can try the editor free. Regular accounts pay from the first new photo they export. One payment covers the marked, clean, boundary and land-size versions of that photo. Complimentary access is limited to designated internal accounts.

For pay-per-export, payment must succeed before paid images are unlocked. A batch can be paid in one checkout. There is no automatic monthly subscription under this pay-per-image arrangement. Re-exporting an unlocked photo, including revised versions, does not incur another export charge on the same account. Newly exported JPEGs and saved projects carry a photo ID so re-imports can retain that access. Keep the original export or project file; removing its identity metadata may prevent recognition. New source photos require another quote.

Where an AI generation has a separate price, it will be shown before you start it. A generation charge and an export charge are different purchases. A failed or cancelled payment does not authorise downloading paid deliverables.

5. Prepaid wallet

You choose a top-up amount within the limits displayed at checkout. Credit is added only after payment is confirmed. It is denominated in AUD, does not expire and can be used for eligible services across your projects. The wallet is for Aerial Editor purchases, not person-to-person transfers or a deposit account; no interest is paid.

The price displayed when you confirm an export or AI request is deducted from your balance. The wallet’s dollar balance is not a promise of a fixed number of future images. We will give reasonable advance notice of price changes and apply them only to new purchases. Previously unlocked exports remain unlocked.

You may request closure and a refund of unused paid credit through info@aerialeditor.com. Refunds will normally go to the original payment method after reasonable identity and transaction checks. Promotional credit has no cash value except where the law requires otherwise. Disputed or incomplete transactions may need resolution before the remaining balance is settled; we will explain any delay. We will not confiscate unused paid credit merely because you stop using the service.

6. Problems and refunds

If a paid export or generation fails, contact support with the transaction reference. We will investigate and provide the remedy required by law, which may include a retry, correction, credit or refund. A charge should not be retained for a service we did not supply.

Australian Consumer Law and other non-excludable rights continue to apply. Nothing here excludes consumer guarantees or limits a remedy that cannot lawfully be limited. A change-of-mind request is assessed separately from statutory remedies and the unused-credit refund arrangement above.

7. Review before delivery

You are responsible for reviewing edits before publication or client delivery. Suggested POIs, camera projections, automated masks and AI results can be inaccurate. Check pin endpoints, place names, drive times, property identity, horizons and any changes to structures, landscaping or visible features.

Boundary outlines, land-size labels and dimensions are illustrative, not a cadastral survey, title search or professional measurement. Verify data independently and use any required disclaimer. Do not publish misleading property imagery or present generated features as existing physical facts.

Keep original images and project-file backups. Browser storage can be cleared and a local project is not automatically a hosted backup.

8. Templates, maps and other services

You must have permission to use agency marks, fonts, templates and photographs you upload. Their presence does not imply an endorsement or partnership. You must preserve required third-party credits and comply with licences applicable to supplied assets.

The service includes Google Maps features and content, governed by the Google Maps/Google Earth Additional Terms of Service and Google Privacy Policy. Attribution must remain visible as required. You may not extract or reuse mapping content beyond the applicable licence. Optional integrations may require a separate provider account and terms.

9. AI and service availability

AI can introduce errors, alter real features or produce unexpected results. Use it only on material you are authorised to submit, inspect the result and keep an unmodified copy. Cloud AI sends the relevant content to the provider described in our Privacy Policy and the feature’s notice. On-device tools have a different processing path.

We will take reasonable care in providing the service, but provider interruptions and maintenance can affect availability. We will communicate planned material interruptions where practical. We will not use this clause to avoid obligations that cannot be excluded by law.

10. Changes and closure

We may improve the service and make proportionate changes needed for security, law or provider requirements. For a material change affecting paid use, our proposed notice period is at least 30 days unless urgent action is necessary. You may stop using the service and request a refund of unused paid credit. Changes do not retrospectively increase the price of a completed purchase.

We may suspend access for a substantiated serious breach or security threat. Where appropriate, we will explain the issue and give a reasonable opportunity to resolve it. Any final closure will include a fair settlement of unused paid credit, subject to lawful transaction disputes. If we discontinue the service, we will provide reasonable notice and an opportunity to save your work, and refund unused paid credit.

11. Responsibility and disputes

Each party is responsible for loss caused by its own breach of this agreement, negligence or unlawful conduct to the extent required by law. Neither party obtains an unlimited indemnity from the other under these terms. [Any specific liability cap must be reviewed for fairness, insurance coverage and statutory exceptions before publication.]

Contact info@aerialeditor.com first so we can investigate a dispute. Our proposed complaint response target is 14 days. This does not prevent you seeking a regulator’s assistance or exercising legal rights.

The proposed governing law is Queensland, Australia, with non-exclusive court jurisdiction, subject to mandatory rights available in your location. [Confirm with the operator and solicitor.]

12. Privacy and contact

Our Privacy Policy explains personal-information handling. Accepting these terms is not blanket consent to optional marketing, advertising tracking or a new AI use. Business and support details: [legal name, ABN, address and email TBA].
